Legal Developments Governing Criminal Records and Expungements

In 2013-2014, Minnesota lawmakers enhanced the privacy rights of job applicants with criminal records and expanded the scope of meaningful criminal record expungement relief in Minnesota beginning January 1, 2015. First, you may have heard of the “ban the box” legislation that now prevents an employer from requiring initial disclosure of a job applicant’s criminal record on a job application. While that inquiry is not banned altogether, this historic legislation evens the playing field at the initial stage of a job application process. And second, Governor Dayton signed a reformation of Minnesota’s criminal record expungement laws that will take effect on January 1, 2015. The reformed law greatly expands the pool of persons with past criminal records who will now be eligible for the relief, as well as enhancing the relief available to an eligible person.
